Acceptable Use Policy

Gage Networks LLP ("Gage Networks") provides its customers with a variety of network, IP telephony and information technology related products and services, including but not limited to those detailed on the Gage Networks website – www.gagenetworks.com (each, a "service" and collectively the "services").

This document defines the acceptable use of the services with a view of ensuring the integrity, security, reliability and privacy of Gage Networks’ network, systems, products, services and data contained therein.

For the purposes of this Acceptable Use Policy, a customer means any party who purchases a service from Gage Networks and an end user or user means any person using a Gage Networks service.

Additional terms and conditions apply where any contract for services is entered in to with Gage Networks and those additional terms and conditions, together with this Acceptable Use Policy, will form a part of such contract.

In the event of a breach of this Acceptable Use Policy or for engaging (or permitting others to engage) in any prohibited activity (as determined by Gage Networks, in its reasonable discretion), Gage Networks reserves the right to suspend and/or terminate a customer’s service with immediate effect without recompense and delete any files held on our servers.

Customer & User Responsibilities

It is the customer's responsibility to ensure that they and their end users comply with the latest edition of the Acceptable Use Policy at any given time. Gage Networks' customers are solely responsible for the content and messages that they post, distribute or otherwise make available using Gage Networks’ network and services.

Whilst Gage Networks cannot actively monitor use of websites and Gage Networks systems under normal circumstances, random checks or investigations may be carried out from time to time to ascertain compliance with this Acceptable Use Policy and to comply with or investigate any enforcement agency, police request or other complaints.

Users are responsible for protecting their password and for any authorised or unauthorised use made of their password. A customer shall not use or permit anyone to use Gage Networks' service to guess passwords or access other systems or networks without written authorisation. In the event of a network or network device being compromised, Gage Networks must be notified immediately and will assist in the tracking and/or expulsion of an offender on the network level to the extent Gage Networks finds reasonable, at its sole and absolute discretion.

Prohibited Activities

Users may not post or send messages substantially similar in content to 10 or more Usenet or other newsgroups, forums, or other similar groups or lists (each, a "list");

Users may not post or send messages, articles, or other content to a list which are off-topic according to the charter or other owner-published FAQs or descriptions of the list;

Users may not send unsolicited commercial messages or communications in any form ("spam");

Users may not falsify user or other service-related information, including, but not limited to, intentionally omitting, deleting, forging or misrepresenting transmission information, including headers, return mailing and Internet protocol addresses, provided to Gage Networks or to other service users or engage in any activities or actions intended to withhold or cloak customers’ or its end users’ identity or contact information.

Users must not engage in any activity that:

  • violates or encourages the violation of a law or regulation (including, but not limited to, libel, slander, invasion of privacy, obscenity, child pornography, export laws and regulations, and infringement or misappropriation of another party's copyrights, trademarks, patents, trade secrets or other intellectual property rights);
  • causes annoyance, inconvenience, harassment, or needless anxiety to others;
  • uses foul, threatening, offensive, insulting or sexually explicit language;
  • threatens the integrity and/or security of any network or computer system (including, but not limited to, transmission of worms, viruses, trojans and other malicious codes and accessing any device or data without proper authorisation);
  • attempts to use the service in such a manner so as to avoid incurring charges for or otherwise being required to pay for such usage;
  • attempts to access the accounts of other users or to penetrate or attempt to penetrate Gage Networks or third party security measures;
  • otherwise degrades or interferes with other users' use of a service;
  • breaches a third party non-disclosure agreement or obligation;
  • breaches any relevant licence terms in connection with any licenced content accessed via the service; or
  • violates generally accepted standards of Internet or other networks conduct and usage, including, but not limited to, denial of service attacks, web page defacement, port and network scanning, and unauthorised system penetrations.

Users must not engage in any of the activities listed above by using another provider's service, but channeling the activity through a Gage Networks account, remailer, or otherwise through a service.

Any indirect or attempted violation of this Acceptable Use Policy by or on behalf of a customer or customer's end user, and any actual of attempted violation by a third party on behalf of a customer or a customer’s end user, shall be considered a violation of the Acceptable Use Policy by such customer or customer’s end user.

Rights and Remedies

Gage Networks may remove any material that in Gage Networks' sole discretion may be inappropriate or that Gage Networks may suspect to be illegal, may subject Gage Networks to liability, or may damage Gage Networks’ reputation, or which may violate this Acceptable Use Policy or where Gage Networks is required to do so by law.

Gage Networks may deny all traffic from known IP address blocks which support indiscriminate port scanning programs such as ProxyHunter, or other unlawful activity, for the purpose of preserving a customer's system and network resources.

Gage Networks reserves the right, where feasible, to implement technical mechanisms to prevent any prohibited activity. In addition, Gage Networks reserves the right to charge the customer to cover administrative costs associated with the prohibited activities of the customer including, but not limited to, recovery of the costs of identifying offenders and removing them from, or discontinuing provision of, the service, in an amount equal to Gage Networks’ actual expenses incurred in preventing or responding to such activity.

For complaints of spam only: In addition to any applicable charges described above, Gage Networks reserves the right to charge the customer the amount set forth under applicable law, such messages being not only annoying to internet users, but also seriously affecting the efficiency and cost-effectiveness of the Network (they increase Gage Networks’ costs by clogging the network, rendering web-sites inaccessible and potentially leading to down time of customers' mission-critical internet applications).

Gage Networks may inform the appropriate authorities and provide them with all information regarding any suspected breach of this Acceptable Use Policy. Gage Networks may be required to monitor, store or copy material sent by the customer or any user and may bring legal action against the customer or any other user.

Nothing in this Acceptable Use Policy limits Gage Networks' rights and remedies (available at law or in equity) in any way with respect to any prohibited activity and Gage Networks may take further action under any contract with Gage Networks that incorporates this Acceptable Use Policy. Gage Networks shall not be under any obligation to provide any notice in relation to the remedial actions that it takes under this Acceptable Use Policy.

The customer shall compensate Gage Networks for any loss or damage that may be caused to Gage Networks as a result of any breach of this Acceptable Use Policy.

Copyright and Other Intellectual Property Rights

Use of the services shall not give the customer or any user any rights in relation to copyright, trade marks or other Gage Networks intellectual property rights or the intellectual property rights of third parties including Gage Networks’ licensors.

Customers or users shall not, without limitation, copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, communicate to the public, or otherwise use the content included in or provided via the Gage Networks systems and services. Customers may, subject to the above, download insubstantial excerpts of such content for the purpose of viewing it provided that no more than one copy of any information is made.

Modifications to this Policy

Gage Networks reserves the right to change or update this Acceptable Use Policy from time to time. Any revisions to this Acceptable Use Policy will be published on the Gage Networks Website.
